Most intellectual property cases involving counterfeit products are criminal cases, not civil matters. Additionally, in most cases, there is no need for an independent expert witness to testify as to the spurious nature of the products in question as this is usually handled by the trademark holders or their private investigators. On many occasions Mr. Schmedlen (who has over 10 years experience in the counterfeit product investigation field) has testified in counterfeit products criminal proceedings on behalf of clients on cases he has investigated. In one case, however, Mr. Schmedlen was employed as an independent opinion expert for the prosecution on a federal criminal case involving a counterfeit product seller. Mr. Schmedlen's role was simply to testify as to the lack of authenticity of the "Burberry" products this vendor was selling. In another, he acted as an independent consultant for an Assistant U.S. Attorney and an I.C.E. Resident Senior Special Agent during the sentencing phase of a trial. Mr. Schmedlen authored the "Stopping Counterfeit Sales" section of the 2002 edition of Security Business Practices Reference, published by the American Society for Industrial Security, International. EXPERIENCE WITH PRODUCT COUNTERFEITING CASES Mr. Schmedlen's experience in this area relates exclusively to investigations of counterfeit products since 1995. During that period, Mr. Schmedlen has represented 30 - 40 manufactures ranging from the Walt Disney Company to Chanel, Coach, Nike, Oakley, etc. He has worked closely with local, state and federal law enforcement and has been involved in over 100 raids and seizures of counterfeit products. In most cases criminal charges were filed and no defendant has ever been found not guilty on these cases. Mr. Schmedlen prepared the initial draft of product anti-counterfeiting legislation updating Michigan's outdated statute for former Michigan Sen. Mike Rogers. A House version passed and became law.
