Racial Profiling is a relatively new class of litigation, but because of recent media exposure and comments made by candidates during presidential debates, the volume of new racial profiling cases is expected to increase.

While Mr. Schmedlen has only functioned as a litigation consultant and opinion expert for the defense on two racial profiling cases--and for the plaintiffs on one--much was learned during the 150+ hours spent on one matter and his experience may well qualify him as one of the few people in the U.S. with any real expertise in this area.

Allegations of this type often relate to surveillance and plaintiffs may erroneously rely solely on videotape evidence as proof of the alleged racial profiling.  Particularly in environments where there are banks of monitors in addition to recording units, videotape evidence alone proves little or nothing in this regard.
