Litigation involving warranty fraud committed by dealers is exceptionally unusual.  In the rare cases the fraud is discovered, settlements are usually negotiated.  When such cases are litigated, the testimony of auditors and investigators is generally sufficient.  However, in some cases, the testimony of an independent opinion expert may prove beneficial.

Over the years, Mr. Schmedlen has been involved in many warranty fraud matters in a consulting and investigative role--both throughout North America and abroad.  Although many of these matters resulted in civil and/or criminal actions, he has only been retained as an independent opinion expert on one case, thus far.  However, his thousands of hours of experience in this specialized field certainly qualify him as an expert.  In all but one of his consulting and investigative cases, Mr. Schmedlen has worked on behalf of defrauded manufacturers.  However, on his single expert case in this area, he was retained by the Federal Public Defenders Office, USDOJ, on behalf of a client who was charged with this crime.

Warranty fraud is often an overlooked exposure in manufacturing businesses, but can result in significant losses.  In one case, the efforts of an investigative team headed up by Mr. Schmedlen resulted in a cash recovery of over $6 million.

Mr. Schmedlen has given presentations on warranty fraud at the International Tire Exhibition & Conference and the Association of Certified Fraud Examiners.  In July of 2007 he provided a limited training seminar on this topic at the quarterly meeting of the Michigan Council of Private Investigators.

Mr. Schmedlen has published several articles on this subject.  He authored the "Warranty Fraud" section of the 1998 edition of Security Business Practices Reference, published by the American Society for Industrial Security, International.

INVESTIGATION EXPERIENCE: WARRANTY FRAUD CASES

Mr. Schmedlen has conducted many successful warranty fraud investigations since approximately 1975.  While most of these warranty fraud cases were in the United states, he has handled these matters in Latin America, Newfoundland and elsewhere.  The actual recovery on one case exceeded $6 million USD, while many others exceded $1 million USD.

Mr. Schmedlen has published articles on this subject.  Additionally he has conducted training seminars and talks on warranty fraud for groups such as the Association of Certified Fraud Examiners (ACFE), internal audit groups, and most recently, in July 2007, the Michigan Council of Private Investigators (MCPI).
